If you're using Ometria's website overlay to capture both email addresses and phone numbers, then there are a few rules you need to follow.
These rules are in addition to SMS country specific marketing compliance.
Two step overlays
When collecting both email addresses and phone numbers for marketing purposes, you must split the fields across two screens; one for email, one for SMS.
Ometria overlays are two-step by default:
Optional SMS consent
The SMS field in your overlay must be optional.
In Ometria it's not possible to set the phone number field to mandatory.
Dismissable overlays
Overlays/pop ups must be dismissable, which means visitors to your website must be able to close the overlay at any time.
Your Ometria overlay includes a close icon by default:
Disclosure
Your overlay must clearly explain what your subscribers can expect from you, and you must include links to both your Terms of Service (ToS) and Privacy Policy.
You must state:
- What the contact is signing up for, i.e. subscribing to receive recurring marketing messages from your brand.
- That marketing consent is not a condition of any purchase.
- Any message and data rates that apply.
- Opt-out instructions and support links where necessary.
You must always include a link to your privacy policy - Ometria includes a content block for this:
Accessibility

As a best practice, we recommend that your overlay includes:
- Bold, clear text explaining the offer.
- A CTA that's easy to read.
Double opt-in
In most cases, double opt-in is a best practice to make sure you're complying with regional data protection guidelines.
